Terms of Service

By creating an account or using Operlyn, you agree to these Terms of Service. If you use Operlyn on behalf of a business, you confirm that you have authority to bind that business to these Terms.

Operlyn provides missed-call text-back, two-way SMS inbox, lead management, and Google review automation tools for home-service contractors. Features may change as we improve the service, but we will not materially reduce the core service during a paid subscription without notice.

You must be at least 18 years old and operate a licensed business eligible to use the service in your jurisdiction. You are responsible for providing accurate account information, protecting your login credentials, and all activity under your account.

Operlyn is offered on monthly plans with a 14-day free trial. Unless you cancel before the trial ends, your subscription automatically renews monthly and the payment method on file is charged the applicable plan fee. You may cancel at any time. Fees are not refundable for partial months or unused service time.

You may not use Operlyn to send spam, deceptive or unlawful messages, abusive content, or messages that violate another person's rights. You must comply with all applicable messaging laws and carrier requirements, including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC registration and messaging requirements.

You are responsible for obtaining and documenting appropriate consent from your customers before sending texts through Operlyn. You must provide required disclosures, honor opt-out and help requests, maintain accurate records, and promptly stop messaging contacts who withdraw consent. You are responsible for the content and recipients of messages sent from your account.

Operlyn and its licensors own the platform, software, branding, and related intellectual property. You retain ownership of the business information, contacts, messages, and other data you submit to the service. You grant Operlyn permission to process that data only as needed to provide, secure, and improve the service.

Either you or Operlyn may terminate an account at any time, subject to any payment obligations incurred before termination. After cancellation, we may retain account data for up to 30 days to support recovery or export, after which it may be permanently deleted unless a longer period is required by law.

Operlyn is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement. We do not guarantee that every missed call will be recovered or every review request will result in a review.

To the fullest extent permitted by law, Operlyn and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from your use of the service. Our total aggregate liability for any claim is capped at the fees you paid to Operlyn during the three months before the event giving rise to the claim.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any permitted legal proceeding relating to these Terms must be brought in the applicable state or federal courts located in Delaware.

We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or through the service. Your continued use of Operlyn after the effective date of an update means you accept the revised Terms.
